Cornwall Council is considering an application for an Order under Section 53 of the Wildlife and Countryside Act 1981, to modify the Definitive Map and Statement of Public Rights of Way: by the addition of a Restricted Byway from Classified Road A30 to junction with unrecorded track (claimed as a Restricted Byway as per application ref WCA 841), at Escalls Common, in the Parish of Sennen. Shown as route A-B on the map.
Cornwall Council is seeking relevant evidence to assist in deciding the order. Modification Orders are about whether public rights already exist, not whether they should be created or taken away. Therefore, only evidence either for or against the accrual of public rights may be considered.
Evidence that will be considered:
- evidence of use of the path by the public
- evidence of any actions taken to prevent or deter the public from using the path as a public right of way
- documentation recording or relating to the path
Evidence that will not be considered:
- suitability of the way for users
- nuisance that users are alleged to cause or have caused
- the need for public access
- desirability of the way
- surface conditions, safety factors or other environmental considerations
